Recent Trials

  • Acquittal on Serious Charges: Our client was charged with Home Invasion First Degree, Assault with the intent to Murder, and Assault with the intent to commit great bodily harm (April 2024). Our Client acted in self-defense and we proved to the jury that he did and that the victim was not creditable.

  • Full Acquittal: Our Client was charged with First Degree and Second Degree Murder. (January 2024) The Prosecution did not offer a plea deal. We successfully fought the allegations. We proved to the jury that our client acted lawfully in self-defense.

  • Acquittal on Murder: Our Client was charged with First Degree and Second Degree Murder. (December 2023) The Prosecution’s plea deal was insulting - they offered him twelve years. We were so confident in our case and our client, we took the case to trial. We successfully proved that the government’s snitch committed the murder. We highlighted the inconsistencies, lack of evidence, and lack of police investigation. The jury acquitted our client of the murder charge and the collateral felony-firearm charge.

  • Full Acquittal: Our Client was charged in the plot to Kidnap and Kill the Governor of the State of Michigan, Gretchen Whitmer. (September 2023) The prosecution did not offer a plea deal. Over the course of three years, we challenged the constitutionality of the statute, reviewed 7 hard drives worth of discovery, and fought endlessly for our client. After a four week trial, the jury acquitted our client on all charges - Providing Material Support to an Act of Terrorism and Felony Firearm. We were lead counsel and successfully prepared our client to testify in order to tell the jury his side of what really happened.   • Reduction: Our Client was charged with First Degree and Second Degree Murder. (August 2023) The Prosecutor did not offer a reasonable plea deal, so our client elected for a jury trial. In this case, we pursued the defense of others. Even though the death of the victim was captured on video, we successfully argued that it was not intentional when our client struck the victim with her car. the After a jury trial, the jury found our client guilty of the lesser included charge of manslaughter. Instead of facing in life in prison, our client received a three-year sentence.

  • Full Acquittal: Our client was charged with Criminal Sexual Conduct - Second Degree. (October 2022) Our client was adamant that he was innocent, so we went to trial. After extensive cross-examination of an eye-witness, the jury was not convinced and acquitted him of all charges.

  • Acquittal on Murder: Our Client was charged with First Degree and Second Degree Murder. (2018) The Prosecutor did not offer a deal in the case, so our client wanted to go to trial. After countless hours were spent studying two large boxes of evidence in the case, The Nunzio Law Firm determined that the crux of the case lied upon the Medical Examiner’s testimony. The Nunzio Law Firm found a Medical Examiner from Eastern Michigan, who primary was a Prosecution witness in criminal cases. After the Defense Expert reviewed the case, he determined that the death might have been an accidental homicide. The Nunzio Law Firm fought hard for our client at trial and received an Acquittal on all Murder Charges. That means we convinced a jury that our client did not commit either first or second-degree murder.

Recent Pretrial Dismissals

  • Dismissed at Preliminary Examination: Our client was charged with Felony in Possession of a Firearm and Carrying a Concealed Weapon. (March 2024) We believed in our client and knew that it was not his gun. During cross-examination, our team highlight that someone else possessed the gun. The Judge dismissed the case.

  • Dismissed Pretrial: Our client was charged with seven counts of Criminal Sexual Conduct in the 1st degree and six counts of Our Client was charged with First Degree and Second Degree Murder. (April 2023) The were two listed minor victims. After an intense, undercover investigation, our team revealed that the victim’s fabricated their stories. The case was dismissed by the prosecutor’s office.

  • Dismissal day of Trial: Our client was charged with Criminal Sexual Conduct in the 3rd Degree (Summer 2023). Even though our client had confessed to the crime, we successfully got a dismissal the day of trial.

  • Dismissal Pretrial: Our client was charged with shooting a woman in the leg. (January 2023). Our client pursued a self-defense and defense of others. Based on our firm’s reputation and asserting our client’s defenses pretrial, the prosecution dismissed all charges.

  • Dismissal at Preliminary Examination: Our client was charged with Armed Robbery and Felony Firearm. (November 2022). Our efforts showed that the complaining witness was not truthful and trustworthy. The prosecution dismissed the case.

  • Dismissal at Preliminary Examination: Our client was charged with Criminal Sexual Conduct in the First Degree. (March 2022). We proved that the complaining witness was sexually assaulted by another perpurtualor. The Judge dismissed the case.

  • Dismissed after Suppression Motion: Our client was charged with multiples counts of Delivery or Manufacture of a Controlled Substance after police found 450 grams of cocaine in his car. (2021) During discovery, we fought with the prosecution because they withheld evidence. After several motions, we finally uncovered a DEA investigation. Despite the Federal and Local Law Enforcement’s efforts, we showed the court that the police conducted an illegal search and seizure. The case was dismissed and our client received his property back.

Recent Favorable Plea Deals

  • Reduction from a Threat of Terrorism to a misdemeanor. (March 2024). Our client faced a several felony charge, where he believe he would go to prison. We successfully received a 1 year misdemeanor plea deal and a no jail agreement from the Judge.

  • Reduction from Criminal Sexual Conduct First Degree and Third Degree to a non-registerable and expungeable felony. (October 2023). After extensive investigation on our client’s alibi, the prosecution offered a sweetheart deal the day of trial. Our client does not have to register as a sex offender and he will be able to pursue an expungement.

  • Reduction from Criminal Sexual Conduct 2nd Degree to a non-jail misdemeanor. (September 2023). Our client had special needs and we fought with the prosecution regarding his confession. Despite a confession, we received a favorable plea deal which ensure that our client would not go to jail and would not have to register as a sex offender.

  • Reduction from multiples counts of Criminal Sexual Conduct Second degree to a misdemeanor. (March 2023). After consultation with our client, we trusted her. The prosecution insisted that the “video” proved the allegations. After careful review, that was false. We fought to seek additional discovery regarding the complaining witness and addressed the truthfulness of his claims based on extensive investigation. After we filed motions, the prosecution offered a reduction from a 15-year felony to a 1 year misdemeanor. Our client only received costs and fines at sentencing.

Past Work

  • Our client was charged with two counts of aggravated assault on two separate victims. After several conversations with our client, we headed to trial. During the Jury Trial, The Nunzio Law Firm successfully cross-examined both victims. After a Jury Trial, our client was found not guilty on both counts.

  • Our client was charged with Human Trafficking. Very early on, The Nunzio Law Firm determined that the important facts of the case were housed in the discovery that the Prosecution was not handing over. The battle to receive and view the discovery lasted several months. Finally, the Judge allowed Damian D. Nunzio, of The Nunzio Law Firm, to review the discovery. The Judge required that Mr. Nunzio, alone, could view the text messages and that he had two weeks to do so. That doesn’t sound too bad! However, there were 85,000 messaged that Mr. Nunzio needed to look over. Because The Nunzio Law Firm is committed to investigating all facts in a case, we uncovered text messages that destroyed the Prosecution’s case. Because The Nunzio Law Firm tirelessly fought for 85,000 text messages over several months, the Prosecution dismissed the case.

  • Our client was charged with Not Sufficient Funds or writing a bad check were the bank was out over $7,000. The Nunzio Law Firm investigated the case and uncovered that a two family members had attempted to deposit money into the account to account for the overages but the bank did not accept either attempt to settle. Because of this information, The Nunzio Law Firm negotiated with the Prosecutor to dismiss the case.
